GRAND RAPIDS, Mich. (WOOD) — A Union City man has been found guilty of embezzling from a family trust, Michigan Attorney General Dana Nessel said.
On Thursday, a jury found 67-year-old David White guilty of one count of criminal enterprise, two counts of embezzlement by an agent/trustee of $50,000 to $100,000 or more, one count of embezzlement by an agent/trustee of $1,000 to $20,000 and six counts of failure to file taxes.
He is scheduled to be sentenced on Jan. 23.
The Attorney General’s Office said that White became the co-trustee of the John Stirling White Trust in 2014 when his father died. Despite John Stirling White having several adult children, the assets were never distributed to the beneficiaries due to ongoing litigation. David White was in control of the trust’s income — which came from The Winery Office Building in Farmington — and access to its financial records.
In 2019, he was removed as the co-trustee by the probate court due to non-compliance with court orders to provide financial accounting for the trust and an investigation was opened. The Attorney General’s Office discovered that David White embezzled at least $400,000 from the trust between 2014 and 2019.
“The hard-earned savings and property of those who have passed must be managed with integrity and respect, not exploited by those entrusted with their care,” Nessel said in a release. “I am grateful to the jury for securing this conviction. My department remains committed to holding accountable those who abuse this responsibility and protecting the estates of Michiganders.”
