GRAND RAPIDS, Mich. (WOOD) — A Sparta Township mother has entered a no-contest plea in the bathtub drowning death of her 8-month-old son last fall.

Olivia Elizabeth Miller, 23, entered the plea Monday to a charge of involuntary manslaughter. The plea came during a status conference before Kent County Circuit Court Judge Mark Trusock.

A plea agreement calls for a sentence of no more than a year in the Kent County Jail, court officials said.

Miller, who is being held in the Kent County Jail, is scheduled to return to court for sentencing in early November.

According to court records, Miller called 911 on Nov. 22, saying her son, Asher Johnson, had drowned at the family’s home on 16 Mile Road NW in Sparta Township.

The child was pronounced dead at Helen DeVos Children’s Hospital in Grand Rapids.

Miller was the only person with Asher at the time, according to court records.

While a probable cause affidavit says her stories varied, Miller told detectives she had put the child in the bathtub with a few inches of water in it. She said she left the room to switch laundry with the water still running.

Miller told detectives when she returned around five minutes later, Asher was floating face up with his face underwater, court records show.

Detectives checked Miller’s phone records and determined she had been on the phone for 21 minutes prior to calling 911, court records show.

She was charged in January with involuntary manslaughter, a 15-year felony, and second-degree child abuse, which carries a 10-year term.
